The site is only a venue allowing for a) the posting of available job opportunities by employers, recruiters and staffing agencies at their companies or companies they represent (hereinafter referred to collectively as “employers”); b) posting of resumes by job seekers; and c) searching our database of available job opportunities or job seekers. Any other use, including mining our database for purposes of marketing and spamming, is not authorized and may result in termination of services in our sole determination.

We are not an employment agency. Emerging Demographics does not evaluate the job listings or other information posted to the Emerging Demographics Websites. Moreover, Emerging Demographics does not investigate or verify the identity of any applicants. Furthermore, Emerging Demographics is not involved in the actual transaction, if any, between potential employers and candidates. Consequently, we have no control over the quality, safety or legality of the job listings posted to the Emerging Demographics Websites, or of applicants responding to postings. Verifying the truth or accuracy of the listings and or applicants, and the ability of employers to hire candidates or the ability of candidates to fill job openings is not a service Emerging Demographics provides.

For Employers

Emerging Demographics, IS NOT AN EMPLOYMENT AGENCY, and assumes no responsibility or liability for any personnel selected by Your company or for the information posted on the Emerging Demographics Websites. Selection, retention or hire of any individual or entity is based solely on Your company's investigation and verification that such hire is suitable for Your company's purposes. By using this site You understand and agree that Emerging Demographics does not screen jobseekers, does not review job seekers’ skills and qualifications, does not determine whether a job seeker may legally work in the US, and assumes no responsibility or liability for any hiring decisions You make.

Emerging Demographics makes no representation or guaranty regarding the effectiveness or timeliness of the Emerging Demographics Websites in meeting Your recruitment objectives. Emerging Demographics does not guaranty that use of the Emerging Demographics Websites will result in any candidate being hired or a position being filled. It is Your responsibility to determine whether a candidate meets the requirements for a position You have available, and Emerging Demographics is not responsible for any hiring decision whatever reason made, by You.

Posting a Job

If You post a job, Your job posting will be available for viewing by job seekers for a period of thirty (30) days or until You receive ten (10) responses from job seekers, whichever occurs first. You are responsible for the accuracy of the information posted. However, the information must contain sufficient detail to convey the nature and requirements of the job opportunity. You may not use the job posting to convey false or inaccurate information, or information that is obscene, sexually explicit, libelous, defamatory, threatening, harassing, or abusive, or to post advertisements or solicitations for business.

Searching the Database

If You have registered to search the Emerging Demographics database of job seekers, You will have the ability to perform an unlimited number of searches. However, You will be limited to downloading fifty (50) resumes each day and contacting 50 candidates each day.

For Job Seekers

By using this site You understand and agree that Emerging Demographics does not screen employers and assumes no responsibility or liability for any decision You make regarding employment opportunities. Employers may not be who they say they are, and by agreeing to use this site You are making Your personal information available to them. The use of that personal information by the employer is no longer within our control and no longer our responsibility. Emerging Demographics can not and does not make any claims as to the privacy of your personal information in the possession of an employer or once submitted by You to our database.

Emerging Demographics is not an employment agency or a recruiting firm, and makes no representation or guaranty regarding the effectiveness or timeliness of the Emerging Demographics Websites in meeting Your employment objectives. Emerging Demographics does not guaranty that any job posting by a prospective employer will result in any candidate being hired or a position being filled, and is not responsible for any employment decision whatever reason made, by any user.

The Privacy Policy posted on the Emerging Demographics Websites is incorporated by reference into this agreement. Please review the Privacy Policy for details regarding the use of information provided by You.

By submitting Your resume, and Your personal information, You are agreeing and allowing Emerging Demographics and its employer subscribers, partners, agents, and personnel to contact You by telephone, cellular phone, email, and SMS (each a “Communication”). The purpose of these calls will be to offer You job opportunities, products or services.

In some cases, when You receive a Communication from Emerging Demographics, You will also hear an advertising or promotional message from one of our partners. While the main purpose of the Communication will be to inform You of employment opportunities, the inclusion of an advertising or promotional message allows Emerging Demographics to continue offering access to employment opportunity. Emerging Demographics may also send you a Communication solely for the purpose of advertising or promoting the product or service of an advertising partner.

ASSUMPTION OF LIABILITY

YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THE EMERGING DEMOGRAPHIC WEBSITES, THE INTERNET GENERALLY, AND THE DOCUMENTS AND INFORMATION YOU POST OR ACCESS AND FOR YOUR CONDUCT ON AND OFF THE SITE.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

IN NO EVENT SHALL EMERGING DEMOGRAPHICS (OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, AGENTS OR ADVERTISERS), BE LIABLE FOR ANY NON-DIRECT DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY, OR BUSINESS INTERRUPTION) RESULTING FROM OR ARISING UNDER OR IN CONNECTION WITH THE USE OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, THE SITE AND/OR ANY DOCUMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT EMERGING DEMOGRAPHICS IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LIMITATION OF LIABILITY

1. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OR LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE LIMITATIONS SET FORTH IN THE PRECEDING PARAGRAPH MAY NOT APPLY TO YOU. IF ANY ARE HELD INAPPLICABLE OR UNENFORCEABLE FOR ANY REASON, THEN EMERGING DEMOGRAPHICS’ MAXIMUM LIABILITY TO YOU FOR ANY NON-DIRECT TYPE OF DAMAGES SHALL BE LIMITED TO $100.

2. IN NO EVENT SHALL EMERGING DEMOGRAPHICS (OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, AGENTS OR ADVERTISERS), BE LIABLE FOR ANY DIRECT DAMAGES IN EXCESS OF THE AMOUNT PAID, IF ANY, TO ACCESS THE SITE.

EQUITABLE RELIEF

Due to the nature of this Agreement, in addition to money damages, You agree that EMERGING DEMOGRAPHICS will be entitled to equitable relief upon a breach of this agreement by You.

WARRANTY INFORMATION; DISCLAIMER

EMERGING DEMOGRAPHICS INC. AND ITS SUBSIDIARIES, AFFILIATES, SUPPLIERS, AND AGENTS DO NOT WARRANT THAT YOUR USE OF THE SITE OR THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT THE SITE (OR THE SERVER(S) ON WHICH IT IS HOSTED) OR SOFTWARE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE AND ANY MATERIALS PROVIDED THROUGH THE SITE ARE ENTIRELY AT YOUR OWN RISK.

ACCURACY OF DATA

You acknowledge that the Emerging Demographics Websites could include inaccuracies or errors. Although Emerging Demographics places a high priority on the integrity and accuracy of the Emerging Demographics Websites, it makes no guarantees as to the Emerging Demographics Websites' completeness or correctness. If You would like to report an error, please contact us at info@Emergingdemographics.com with a description of the issue and its location.

You acknowledge and agree that You are solely responsible for the form, content and accuracy of any job listing, resume or other material You post to the Emerging Demographics Websites. “Emerging Demographics Inc.” neither warrants nor guarantees that a job posting will be viewed or reviewed by any specific number of users. We are not to be considered as an employer with respect to Your use of the Emerging Demographics Websites and we shall not be responsible for any employment decisions made by any entity posting job listings or resumes to the Emerging Demographics Websites.

RISKS

You acknowledge that there may be certain risks, including but not limited to the risk of physical harm and of dealing with strangers, underage persons or people acting under false pretenses, associated with pursuing applicants begun through the Internet. You assume all risks related to dealing with other users with whom You have had contact through the Emerging Demographics Websites.

RELEASE OF LIABILITY

Because user authentication on the Internet is difficult, Emerging Demographics cannot and does not confirm that each User is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on Emerging Demographics in the event that You have a dispute with one or more Users, You release Emerging Demographics, and its affiliates, and their respective officers, directors, employees and agents, from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

AMENDMENTS TO THIS AGREEMENT

Changes are periodically made to the Emerging Demographics Websites and may be made at any time. In the event that we change our Terms of Use, the new document will be available under the "Terms of Use" link on our website. The terms become effective as soon as they are posted on our website. It is the sole responsibility of every user to review the latest terms. You can remove Yourself from our database by emailing remove(@)emergingdemographics(.)com with Your name and phone number, or by calling us at 877-524-2622.

INDEMNITY

You agree to defend, indemnify, and hold harmless Emerging Demographics, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to Emerging Demographics or any Emerging Demographics Website, (ii) Your use of Content on the site, or (iii) Your breach of the terms of these Terms of Use. Emerging Demographics shall provide notice to You promptly of any such claim, suit, or proceeding.

POSTING DATA

By using the Emerging Demographics Websites, You agree that the information You are providing is accurate, and You are acknowledging that we are not an employment agency and we do not guarantee the accuracy of all or any of the employment information which is made available to You.

 

It is possible that in the future Emerging Demographics or one or more websites comprising the Emerging Demographics Websites, could be acquired or merges with another company. In such event, the acquiring company will have access to all of Emerging Demographics' user information. See the Emerging Demographics Privacy Policy for more details.

TERMINATION

These Terms of Use will remain in full force and effect while You are a user of any Emerging Demographics Website. Emerging Demographics reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of any information you have posted on an Emerging Demographics Website and immediate termination of your registration with or ability to access the Emerging Demographics Websites, upon any breach by You of these Terms of Use or if Emerging Demographics is unable to verify or authenticate any information You submit.
